Welcome to mobi Solutions! By accepting our Quotation, you are entering into a legally binding agreement governed by the following detailed Terms and Conditions ("T&C") in conjunction with the Merchant Agreement. Please take the time to thoroughly review these terms, as they outline your rights, responsibilities, and the mutual agreement between you and mobi.
Privacy Policy Acknowledgment
Upon your acceptance, you also acknowledge and agree to abide by the terms outlined in our Privacy Policy, accessible on our website [https://gomobi.io/]. This policy serves as an integral part of our commitment to transparency in handling your information.
Scope of T&C
These T&C encompass all mobi products and services ("mobisolution") as detailed in the accepted Quotation. This includes, but is not limited to, various services such as EZYWIRE, EZYWIRE Plus (EZYWIRE+), EZYLINK, EZYLINK Lite, EZYMOTO, EZYMOTO VCC, EZYWAY, EZYREC, EZYREC Plus (EZYREC+), EZYAUTH. Familiarize yourself with the specifics mentioned in your Quotation.
Contractual Period
Unless explicitly specified otherwise in the Quotation, the majority of plans do not have a fixed contractual period. Both parties, meaning you and mobi, retain the right to terminate this agreement by providing one month's notice. In simpler terms, if there's no specific timeframe mentioned in your plan details, either party can end the agreement by giving a one-month advance notice.
Zero-Setup Fee Up-Front
Certain subscription plans provide the flexibility of opting for a zero-setup fee up-front. This means that, if you choose this option, you won't be required to make an initial payment for the setup of the service. Instead, the billing for the setup fee will take place at the time of the service going live or becoming operational. In practical terms, the setup fee will be deducted from the settlement proceeds – the funds received from successful transactions.
It's important to note that the availability of this zero-setup fee option is subject to specific conditions outlined by mobi. These conditions may include factors such as the type of plan selected, the nature of the services provided, and any other criteria set by mobi to govern the use of this particular billing arrangement. Users should review the terms and conditions of their chosen plan to understand the exact conditions that apply to the zero-setup fee option.

Refund Policy
Mobi maintains a strict no-refund policy for its services. Nevertheless, if your application is rejected, mobi is committed to refunding the amount you paid. However, a processing fee of RM200.00 will be deducted from the refund amount. This fee is applied to cover administrative costs associated with processing the refund. It's important to be aware of this policy in the event of an application rejection to understand the terms of the refund process.
Welcome Letter and Account Activation
Upon acceptance, you will receive a welcome letter detailing information about your mobisolution account. Your acceptance of this letter signifies the commencement and activation of your mobisolution account.
Mobi's Rights
Mobi holds specific rights, such as the ability to suspend services for inactive accounts and withhold payments under certain conditions. If reactivation is required after an account suspension, it may be subject to a fee. In essence, mobi has the authority to temporarily stop services for inactive accounts and may charge a fee for reinstating those services.
If the card payment service for your account remains suspended for over thirty (30) days, you must submit a new application and may need to pay the setup fee once again.
Mobi reserves the right, at its sole discretion, to withhold any payment to you, establish a reserve account, or take other appropriate actions if mobi, along with our acquirer, bank, or e-wallet operators, believes that the transaction is deemed invalid, fraudulent, counterfeit, suspicious, used for illegal and/or wrongful purposes, or constitutes a prohibited payment transaction as outlined in the Merchant Agreement. You are obligated not to submit any payment transaction to mobi that you know or should have known to be fraudulent, counterfeit, suspicious, for wrongful purposes, or constitutes a prohibited payment transaction.

Onsite Technical Support Fee
If you need onsite technical support, fees will be applied based on your location. Different rates are applicable for Kuala Lumpur and Selangor, other areas within Peninsular Malaysia, and Sabah and Sarawak. In simpler terms, the cost for onsite technical support varies depending on where you are situated, with specific rates for different regions.
Responsibility for Device Loss
Subscribers to EZYWIRE plans are responsible for any loss of devices, and replacement costs are specified for both the EZYWIRE mPOS Reader and EZYWIRE Plus Card Terminal. In simpler terms, if you subscribe to EZYWIRE plans and lose the devices, you will be responsible for covering the replacement costs as detailed for each device.
EZYWAY Integration and Upgrades
Subscribers to EZYWAY plans are required to integrate and upgrade their systems to comply with the latest API specifications provided by mobi. It's essential to notify mobi in the event of any connectivity failures. In simpler terms, if you choose EZYWAY plans, you need to ensure your systems are in line with the latest specifications, and you must promptly report any issues with connectivity.
EZYMOTO and EZYMOTO VCC Authorization
To charge any payment card transaction, except for virtual payment cards from online travel marketplaces like Agoda, Booking.com, etc., you must secure written consent and authorization from the cardholder. This written authorization should include:
- Name of the cardholder
- Identification number of the cardholder
- Contact details of the cardholder
- Last four (4) digits of the card
- Name of the card issuer
- Purpose or description of the transaction
- Consent from the cardholder if paying on behalf of another person
EZYAUTH Pre-Authorization
Approval for the pre-authorization function (EZYAUTH) depends on mobi and/or our acquirer's discretion.
EZYAUTH puts a temporary hold on a specific amount in a credit or debit card until you complete the sale. Voiding or canceling a pre-authorization doesn't result in a refund since it's not an actual charge.
Pre-authorizations follow the card issuer's policy, with a validity period generally being thirty-one (31) days for Hotel & Lodging and Car Rental businesses and seven (7) days for others. If it becomes invalid:
- You can't complete the sale, void, or cancel the transaction.
- Monitor validity and cancellation periods as mobi can't extend or amend the card issuer's policy.
- Customers must resolve pending charges with their card issuer.
- You complete the sale
- Void or cancel the pre-authorization.
- The pre-authorization expires/lapses.
Reversal or Refund Responsibility
As a user, you are responsible for managing transaction reversals or refunds. mobi does not refund the Merchant Discount Rate (MDR). To proceed with any reversal or refund, users must ensure the full transaction amount is funded beforehand.
Other Payment Methods
The availability of e-wallet and FPX services is subject to approval and separate policies. Transaction limits, including amount restrictions, are determined by PayNet and the respective banks or e-wallet operators.
Daily Transaction Limit (DTL)
The Daily Transaction Limit (DTL) mentioned in the welcome letter applies specifically to payment card transactions. Requests for an increased DTL are subject to approval.
Service Interruption Disclaimer
Mobi wants to make it clear that any disruptions in service due to system incompatibility or failure to comply with technical specifications are not the responsibility of mobi. It's important for users to ensure that their systems align with the specified technical requirements to avoid any interruptions in service.
Fees, Charges, and Settlement
All fees, charges, and settlement periods specified in the Quotation are binding and must be adhered to. Users are expected to refer to the Quotation document for precise details regarding the financial aspects of their engagement with mobi. Any deviations from the agreed-upon terms may result in necessary actions as per the Quotation.
Indemnification
Users acknowledge and consent to indemnify mobi and/or our Acquirer against any potential losses, claims, or penalties that may arise due to reversals, chargebacks, or transactions deemed fraudulent. This indemnification agreement encompasses financial responsibility for any adverse consequences resulting from the mentioned situations. Users are expected to promptly address and compensate for any liabilities incurred by mobi and/or our Acquirer as a result of such incidents.
